  • Uploading weapons or parts subject to export control regulations such as ITAR, EAR beyond EAR99, or EU Dual Use (collectively, “Export Controlled Data”) is a violation of our terms of use
  • We do not manufacture and accept PCB products intended for weapons, military equipment, or related equipment.
  • Under ITAR and EAR, which govern the export of weapons and weapons-related technology from the United States, you must indicate whether your board design data is ITAR-controlled.
  • "International Traffic in Arms Regulations" which govern the export of weapons and weapons-related technology from the United States. Please indicate whether your board design data is ITAR-controlled or not.
  • You further represent and warrant that Your uploaded data (including PCB files, related drawings and materials,) and/or Your Order comply with, and do not violate, the following pcbpro.online content policy (the “Content Policy”). You represent and warrant that Your uploaded data (including PCB files, related drawings and materials),Your Order and/or the production, shipping, sale and use of the Parts or tooling by us: 

Does not contain any weapons. Weapons is broadly defined as:

  • Firearms, firearm component parts, or ammunition. This includes
  • (1) any device which will or is designed to or may readily be converted to expel a projectile by the action of an explosive; (2) any device capable of being concealed on the person from which a shot can be discharged through the energy of an explosive; (3) any component part integral to the safe firing of a projectile by means of an explosive from a device described in (1) or (2); and (4) ammunition including cartridge cases, primers, bullets, or propellent powder designed for use in any firearm;
  • Bladed weapons. This includes knives designed to cause bodily harm and any part or component thereof.  A bladed weapon includes automatic knives, knives that are undetectable by a metal detector, stilettos, switchblades, butterfly knives, throwing knives, folding knives, gravity knives, and disguised knives (for example, a sword cane).  
  • Explosive devices. This includes grenades, rockets, explosives, incendiary devices, missiles, land mines, and related parts or components thereof;
  • Toy guns or other items with arms-like appearance. This includes paintball guns, airsoft guns, training weapons, mock guns, mock weapons, weapon replicas and items that look like a gun or other weapon; and Arms-related items and/or weapon accessories. Accessories, parts or components to any weapon if that accessory/part/component contributes to the functioning of the weapon and/or attaches to the item. For example, this includes scopes, mounts and knife handles because they are attached to a weapon, but would not include a knife case or holster because they are neither attached to nor contribute to the functioning of the weapon.
  • Does not contain any critical (functional) parts for aerospace, watercraft, offshore, automotive and or medical applications;
  • Does not violate, misappropriate or infringe any intellectual party rights (including but not limited to any copyright, patent, design right, trademark, trade secret or any other proprietary rights) or any third party rights;
  • Does not contain information, which is false, inaccurate, misleading, harassing, racially or ethnically offensive, discriminatory, harmful to minors, libelous or defamatory, including information used to produce counterfeit goods;
  • Is not contrary to or in violation of any applicable law or regulations or public policy; and Does not violate our Export Control Policy.

 

Part III – Conflict-Free Minerals Statement

  • Conflict Metal means metals of gold (Au), tantalum (Ta), tungsten (W), cobalt(Co), tin (Sn) and so on are derived from or sourced from mines in conflict areas of the Democratic Republic of Congo (DRC), or illegally taxed on trade routes, either of which are controlled by non-governmental military groups, or unlawful military factions.pcbpro.online banned to use conflict metals and expects our suppliers to comply with the Electronic Industry Citizenship Coalition (EICC) Code of Conduct and to only source materials from environmentally and socially responsible suppliers and require all vendors purchase and use conflict-free metals, and priority source from smelters listed in EICC-GeSI Conflict-Free Smelter(CFS).
  • Therefore pcbpro.online will commit to the sourcing of “Conflict Free Minerals” through our suppliers to comply with the regulations with Conflict minerals.

 

1.General

1.1 Your privacy is important to us. This privacy policy (“Privacy Policy”) applies to all personal information collected through and/or processed in connection with http://www.pcbpro.online (the “Website”), the services offered by pcbpro.online and verbal, email, text and other electronic messages and other communication methods between you, our Website and/or pcbpro.online personnel. In this Privacy Policy, we inform you of our practices with respect to the collection and use of your personal information when visiting our Website or using our services. Unless otherwise defined in this Privacy Policy, terms used here starting with a capital letter shall have the same meaning as in our General Terms of Sale. 1.3  We collect and use personal data only for specified and lawful purposes, including: (a) account registration, order processing, delivery, and after-sales support (necessary for contract performance), retained for the contract term and applicable limitation periods; (b) security, fraud prevention, and service integrity (legitimate interests), retained up to 24 months unless required longer by law; (c) regulatory, tax, and export-control compliance (legal obligation), retained as required by law; (d) marketing communications (consent), retained until consent is withdrawn; and (e) cookies/analytics (consent), retained according to the cookie lifespan.

 

1.4 Data subjects have the right to access, rectify, erase, restrict, object, request data portability, and withdraw consent where applicable. Requests must be sent to  fiona wang@ pcbpro.online with sufficient information to verify identity. We will respond without undue delay and in any event within 30 days, subject to lawful extensions or exemptions.

2.Your representations

2.1. You represent and warrant that You have the right authority and capacity to enter into these General Terms of Sale (on behalf of Yourself or the entity that You represent) and that You are authorized to place an Order. You represent and warrant that You are 18 years or older and are able to conclude legally binding agreements.

2.2. You represent and warrant that You have the full right and authority to provide us with all data (including PCB files), documentation, drawings and specifications, all data You provide is accurate and truthful, and You are authorized to grant the license referred to in Section 1.

2.3. You also represent and warrant that You will use Parts in strict accordance with all applicable state, federal and local laws and requirements.

2.4. You represent and warrant that You understand and agree with, including making the relevant certifications under, this pcbpro.online export control policy (the “Export Control Policy”), as follows:

  1. You understand that pcbpro.online does not accept Export Controlled Data. “Export Controlled Data” is defined as data which is controlled for export under United States (“U.S.”) law. This includes (technical) data and/or end Parts that are: (1) controlled under the International Traffic in Arms Regulations, or (2) subject to the Export Administration Regulations, and controlled at any level beyond EAR99.
  2. You certify that Your data (including PCB files) and/or Your Order DOES NOT include Export Controlled Data. 
  3. You certify that You understand that it is Your responsibility to determine and provide the appropriate export classification for the products and related technology and software to be provided to pcbpro.online and to comply with prohibition on Export Controlled Data provided herein. pcbpro.online relies entirely on You to provide accurate information for purposes of compliance with applicable export control laws. The export classification indicates whether the product and related technologies are controlled, the relevant jurisdiction or jurisdictions, when an export license is required, and whether the product and technology qualify for a license exception. An incorrect classification could result in export control violations, which could in turn lead to significant fines and other sanctions. 
  4. You represent and warrant that the production, shipping, sale and use of the Parts or tooling by us in response to Your Order, does not violate any export control laws or regulations. 
  5. You represent and warrant that You will not, directly or indirectly, (i) sell, export, reexport, transfer, divert, or otherwise dispose of any products, software, or technology (including products derived from or based on such technology) received from pcbpro.online to any destination, entity, or person prohibited by the laws or regulations of the U.S. and/or Your local jurisdiction or (ii) use Parts for any use prohibited by the laws or regulations of the U.S., and/or Your local jurisdiction, without obtaining prior authorization from the competent government authorities as required by those laws and regulations.
  6. You may not use pcbpro.online’s services if You are the subject of U.S. sanctions or of sanctions consistent with U.S. law imposed by the governments of the country where You are using pcbpro.online’ services. 

 

  • We reserve the right to suspend or cancel any order, without liability, if it determines in its sole discretion that fulfillment of your order will possibly violate applicable export control or sanctions laws and pcbpro.online shall not be liable for any incorrect or false export classification, license, or other information provided by you.
  • You agree to indemnify, defend, and hold harmless pcbpro.online from and against any and all claims, liabilities, losses, damages, penalties, costs, and expenses arising out of or related to any breach by you of the representations, warranties, or obligations set forth in this Section

11.About website log

The PCB design documents used for manufacturing were provided by customers and the responsibility of pcbpro.online was to manufacture the PCB board according to design of customers.

Customers shall have rights under the Personal Data Protection to access, correct, delete, or request portability of their personal data, as well as the right to withdraw consent or object to certain processing, subject to legal and contractual limitations. Customers shall guarantee its ownership and the related intellectual property rights of the design document provided, which should not infringe anyone else's intellectual property rights and any other legal right, such as patent right, copyright, trademark right and so on.

Customers shall indemnify and hold pcbpro.online harmless from any claims, damages, or liabilities arising out of or related to the design documents provided, including but not limited to intellectual property infringement, regulatory violations, or other legal claims. To the maximum extent permitted by law, the services are provided “as is” and “as available” without any warranties or guarantees of any kind or nature, either express, implied or statutory, including, but not limited to, any (if any) implied warranties, duties or conditions of merchantability, of fitness for a particular purpose, of accuracy or completeness of responses, of results, of workmanlike effort, of lack of viruses, and of lack of negligence, all with regard to the Services.

We shall not be liable for any products purchased through unauthorized distributors, resellers, or channels other than pcbpro.online.

13.Shipping Providers

We offer shipping through third parties such as DHL, EMS, FedEx, UPS, HongKong Post and the United States Postal Service. With your consent, We pass delivery addresses, phone numbers, and invoices to these companies to the extent required for quoting shipping prices and successful delivery of orders.

14.Force Majeure

pcbpro.online shall not be responsible for any delay or failure in delivery or performance of any of its duties under any Order due to events beyond its reasonable control or acts or omissions or any other occurrence commonly known as force majeure, including but not limited to war, riots, acts of terrorism, acts of God, pandemics, natural disasters, embargoes, strikes, or other concerted acts of workers, casualties or accidents, failure by any pcbpro.online’s manufacturing partner to meet their obligations or any other causes or circumstances that prevent or hinder the manufacture or delivery of the Parts&PCB.

pcbpro.online may suspend performance under an Order for so long as such performance is delayed by such occurrence or cancel the Order at its sole discretion, in which case pcbpro.online is not liable for any resulting damages.

15.Payment Providers

Payments for buying PCBs at pcbpro.online are processed through Paypal. When using PayPal on pcbpro.online, a user should provide their PayPal email address. The user will then be directed to the website paypal.com to complete their payment, after which they will be redirected to pcbpro.online to complete the order. In case you do not have a Paypal account, credit card data including the cardholder name, credit card number, expiration date, CVV, and full billing address are sent to Paypal via an API for processing. Details regarding orders are not sent to Paypal. Each transaction is logged by retaining the transaction amount, the customer’s name, addresses and phone numbers. We do not store any credit card data on pcbpro.online’s servers at any time. Your credit card information is immediately tokenized the first time it is processed. Tokenization is a process in which credit card information is captured by a secure payment processor, and replaced by a randomly generated number. Should you elect to save a credit card to your account for future use, only the encrypted token is stored and used to charge your credit card account.

16.Data Disclosure or Storage, Transfer, and Processing

Fulfilment of legal obligations: Due to the mandatory laws of the European Economic Area or the country in which the user lives, certain legal acts exist or have occurred and certain legal obligations need to be fulfilled. We are not responsible for the privacy practices employed by those third parties, nor are we responsible for the information or content their products and services contain. We will not be responsible for any damage in connection with your personal data arising from the data disclosure by such third parties.
